Terms of Use

Last updated: [date]

Draft. These terms are being reviewed before PeekaSpeak launches and may change.

These terms are an agreement between you and [Company legal name] ("we", "us") for PeekaSpeak ("the app"). By creating an account or starting a subscription, you agree to them.

1. Who can use the app

2. What the app is, and what it is not

The app offers play-based activities to support early speech, language and learning milestones. It is not a medical device, a diagnosis, or a substitute for a speech-language pathologist, doctor or other professional. Comparisons with "most kids this age" are general guides drawn from public milestone sources, not an assessment of your child. If you have concerns about your child's development, talk to your pediatrician or a licensed speech-language pathologist.

3. Your account

4. Subscriptions and free trial

5. Acceptable use

Please do not copy, resell, reverse engineer or misuse the app, try to reach other families' data, or interfere with the service. We may suspend accounts that do.

6. Content and ownership

7. Sharing features

If you share a milestone card or a family link, you choose who receives it and you are responsible for sharing it only with people you trust. You can turn off a family link at any time.

8. Changes to the app and these terms

We may update the app and these terms. If a change is significant, we will tell you in the app or by email before it takes effect and, where the law or app stores require it, ask for your consent again. If you do not agree, you can stop using the app and cancel your subscription.

9. Disclaimers and limits of liability

The app is provided "as is". To the extent the law allows, we do not promise that it will be error-free or achieve any particular developmental result, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

10. Apple-specific terms

If you got the app from the Apple App Store: these terms are between you and us, not Apple; Apple has no obligation to provide support or maintenance; if the app fails to meet a warranty, you may notify Apple for a refund of the purchase price (if any) and Apple has no other warranty obligation; Apple is not responsible for claims relating to the app, including product liability, legal or regulatory compliance, or intellectual property claims; you confirm you are not in a U.S.-embargoed country or on a U.S. government restricted-party list; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.

11. Disputes

If you have a problem with the app, please email us first at support@peekaspeak.com and give us 30 days to try to resolve it informally. If we cannot, either of us may bring the claim in small-claims court or in the courts of [State], and these terms are governed by the laws of [State].
